National Civil Service |
|
| |
The national civil service includes every officer and employee of a national body or agency, except as otherwise provided in this Charter. All positions in the civil service shall be subject to the terms and conditions of employment as specified by the civil service statutes. |
|
| |
In the civil service, permanent appointment and promotion shall be made under a general system based on merit ascertained by competitive examination. |

| 53.2 |
National Civil Service Board |
|
| |
Vested by this Charter, a board called the National Civil Service Board shall be established comprising of eight (8) members, of which four shall be members of Congress, appointed by Congress by a simple majority vote for a period of four years and four shall be appointed by the President. |

| |
Upon ceasing to be a member of Congress, a Board member shall automatically no longer be a member of the Board and a vacancy shall be declared. The board shall annually shall elect one of its members as presiding officer. |
|
| |
The board shall enforce the civil service statutes and, by majority vote of all its members, shall prescribe probationary periods and classifications, adopt other rules authorized by statute, and review disciplinary actions. |

| 53.3 |
Exemption from Civil Service |
|
| |
The following officers and employees of Government and agencies are exempt from Civil Service: |
|
| |
(i) Those appointed or employed by the Legislature, either house, or legislative committees |
|
| |
(ii) Those appointed or employed by the judicial branch or associated agency; |
|
| |
(iii) Those appointed or employed in the military or associated agency; |
|
| |
(iv) Officers elected by the people and a deputy and an employee selected by each elected officer; |
|
| |
(v) Members of boards and commissions |
|
| |
(vi) Officers directly appointed by the Executive branch with or without the consent or confirmation of the Parliament; |
|
| |
(vii) Other positions that Congress has voted as being exempt. |
