Appointment Commission |
|
| |
All appointments to Cabinet positions, Judiciary and heads of Statutory Authorities shall be subject to an Appointment Commission formed for that purpose. |
|
| |
The Appointment Commission shall be formed of not more than twelve (12) elected representatives, with six(6) from Congress and six (6) from the Senate including a nominated Chair person by the President so that no Political Party has the majority of representation. |

Conduct of Appointment Commission |

| |
The purpose and task of an Appointment Commission is to establish that an individual to be appointed to a senior position is the most suitable candidate and capable of managing their affairs to the best interest of the Nation. |
|
| |
It is not the purpose of the Appointment Commission to deliberately weaken the mandate of the present Government, nor seek to denigrate the good name of any candidate. |
|
| |
Members of an Appointment Commission are forbidden to ask personal questions concerning the private life of a candidate including their personal opinions and views. Any Member who breaches this rule shall be liable for immediate expulsion from the Appointment Commission including disciplinary action. |

However, where a candidate has made publicly recorded statements either through Judicial action or their role as an Officer of a Company, then the members of the Appointment Commission is free to ask questions relating to such matters. |

| 132.3 |
Grounds for denying a Candidate Appointment |
|
| |
An Appointment Commission has the power to deny the appointment of a Candidate. When this occurs, the individual is not permitted to be nominated for appointment again during the life of the Parliament. |
|
| |
A Candidate may only be denied appointment on the following conditions: |
|
| |
(i) That review of their record and skills demonstrates a clear lake of suitability for the role to which they have been nominated; or |
|
| |
(ii) That the candidate has clearly demonstrated a willful lack of respect for Due Process of the office to which they have been nominated. |

Length of Appointment Commission |
|
| |
An Appointment Commission may only exist for a period of seven (7) days from the date the candidate is summonsed to give testimony and first gives evidence. |
|
| 132.5 |
Limit of members to Appointment Commissions |
|
| |
No member of Parliament may serve on more than three (3) Appointment Commissions during the life of the Parliament. |
